Common Charge

Uttering a Threat is a serious offence and is codified in section 264.1(1) of the Criminal Code. Anyone commits an offence who, in any manner, knowingly utters, conveys or causes any person to perceive a threat:

a) to cause death (Death Threats);

b) bodily harm to anyone;

c) to burn, destroy, or damage real or personal property; or

d) to kill, poison, injure an animal or bird that is the property of any person.

On Summary proceedings under (a), (b) or (c), Crown can ask for up to 18 months incarceration. If the case proceeds to Indictment, the Crown may seek up to 5 years imprisonment.
